Kurts Gas Appliances  / Kurts Registered Gas Installers cannot and will not be held responsible for any unforeseen damages caused through drilling through a wall.

Kurts Gas Appliances  / Kurts Registered Gas Installers cannot and will not be held responsible for any unforeseen damages caused through drilling through a water pipe, (i.e. water pipes in walls, or floors etc

Kurts Gas Appliances  / Kurts Registered Gas Installers cannot  and will not be held responsible for any unforeseen damages caused through drilling through a drainage pipe, (i.e. drainage pipes in wall, or floor etc

Kurts Gas Appliances  / Kurts Registered Gas Installers cannot  and will not be held responsible for any unforeseen damages caused through drilling through a electrical wire , (i.e. electrical wires water in walls, or floors etc

Kurts Gas Appliances  / Kurts Registered Gas Installers cannot  and will not be held responsible for any unforeseen damages caused through drilling through a airconditioning wire or pipe , (i.e. airconditioning pipes or wires in walls, or floors etc

Kurts Gas Appliances  / Kurts Registered Gas Installers cannot  and will not be held responsible for any unforeseen damages caused through drilling through a underfloor heating  or pipe , (i.e. underfloor heating pipes or wires in walls, or floors etc

PLEASE NOTE: There is a possibility that your new appliance and/or installation are not operational when payment is made. This will only be due to various reasons beyond the control of Kurts Gas Appliances  / Kurts Registered Gas Installers  (eg: no gas, no meter etc).

As all care is taken during the installation, we cannot be held responsible for any unforeseen damages caused (i.e. plumbing in wall, plaster damage,electrical damage,drain pipe damage,aircon damage,underfloor heating damage etc

A. The following Terms and Conditions contain assumptions of risk and/or liability by you and limit and exclude liabilities, obligations and legal responsibilities which Kurts Gas Appliances (Proprietary) will have towards you and other persons. These Terms and Conditions also limit and exclude your rights and remedies  Kurts Gas Appliances  and place various risks, liabilities, obligations and legal responsibilities on you. These Terms and Conditions may result in you being responsible for paying additional costs and amounts and Kurts Gas Appliances  may also have claims and other rights against you.

B. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (the "Consumer Protection Act"), no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.

   C. Please read these Terms and Conditions carefully. Participation agreeing by means of a deposit or a payment for an gas installation,  or a repair of a gas installation or a sale of a appliance will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this offering.

1.    Quotations are valid for 5 working days, unless otherwise stated.

2.    It is the Client / Contractor’s responsibility to ensure that all items be removed from counter tops and inside cupboard / cupboards before the installation commences. If any cupboard / cupboards need to be moved in order for the installation to take place, this must be done prior to the commencement of the gas installation. Kurts Gas Appliances does not take any responsibility for damage to goods left for Kurts Gas Appliance to be moved from where the installation is taking place.

3.    Chasing, trenching, backfilling, making good, electrical work, painting or the removal of rubble is Not included unless stated in writing on the quotation.

4.    A Call out fee will be charged by Kurts Gas Appliance where for whatever reason a second or more site visits need to be done.

5.    Unless Kurts Gas Appliance supplies the gas cylinder/ s it is the customers responsibility to ensure that the gas cylinder/s are on site before the gas installation is to take place.

6.    Should Kurts Gas Appliances  be required to dig trenching and/or chase or drill walls Kurts Gas Appliances  will not be liable for any damage caused unless concealed services (electric, water, sewers,airconn,underfloor heating etc) is clearly marked and pointed out prior to commencement by Kurts Gas Appliances  .

7.    In the event of the purchaser preventing Kurts Gas Appliances  from completing the quoted installation for any reason within 30 days from commencement of the installation, 90% of the full contract/agreed price falls due on the 31 st day.

8.    Notwithstanding delivery and/or installation of goods, the ownership of goods will not pass to the purchaser until all monies due have been paid and received by Kurts Gas Appliances.

9.    All work, materials and controls supplied by Kurts Gas Appliances are warranted for a minimum of 1 (one) year. No Warranty or guarantee is given on regulators and Change Over Valves   as  the importers will not warranty/guarantee a regulator/ Change Over Valves  because of dirty liquid petroleum gas in South Africa. (For a new appliance - The manufacturer will be responsible for their product while under warranty. The new appliance itself will not be maintained in any way if the warranty is outdated or has expired.).

 

10.  Any tampering with, or adjustments to any equipment, appliance or installations by anyone other than Kurts Gas Appliances will immediately invalidate all guarantees.

10B. If The Gas Appliance is in any way faulty and the contractor or customer or end user calls in the manufacturer or importer or seller of that gas appliance on a warranty claim and the appliance technician disconnects (tampers with) any of my connections on the gas appliance or on the gas cylinder side or any where else on the gas installation.Kurts Gas Appliances will immediately invalidate all guarantees. 

10B. Please take note below and ensure that the person who the appliance company sends out to inspect the gas appliance is a registered gas installer who is qualified to connect and disconnect your gas appliance.  Please See Point  " C " below.

SAQCC – GAS Pressure Equipment Regulations (PER)

‘Pressure Equipment Regulations’ No. 734

Summary: The Minister of Labour published on 15th July 2009, an amendment to the Occupational Health and Safety Act 1993 in respect of the ‘Pressure Equipment Regulations’ No. 734.

These regulations set out the requirements regarding the design, manufacture, operation, repair, modification, inspection and testing of pressure equipment with a design pressure equal to or greater than 50kPa, in terms of the relevant health and safety standard incorporated into the Regulations under section 44 of the Act.

In terms of the Occupational Health and Safety Act, 1993, the Pressure Equipment Regulations require anyone working on a Gas system to undergo specific training and are registered with the South African Qualification and Certification Committee – Gas (SAQCC Gas) on behalf of the Department of Labour.

Regulation 1: Definitions

“Authorised Person” means… a person who is registered as competent within the scope of work for which an organisation [SAQCC Gas] approved by the chief inspector has registered that person.

Regulation 17: Gas reticulation equipment and systems

1.” No person shall

(a) handle, store or distribute any gas in any manner which includes the filling of a container, other than in accordance with the relevant health and safety standard incorporated into these Regulations under section 44 of the Act;

(b) install or remove an appliance, pressure equipment or system for gas in any manner other than in accordance with the relevant safety standard incorporated into these Regulations under section 44 of the Act;

c) install or remove a gas appliance, or a gas system or a gas reticulation system, unless such person is an authorised person; or

(d) use pressure equipment or systems for gas in an manner other than in accordance with the relevant safety standard incorporated into these regulations under section 44 of the Act

2. After installation or re-installation, and before commissioning a gas system, the user shall ensure that an external inspection and a leak test are performed by an authorised person or an approved inspection authority as applicable in terms of sub-regulation (1 )(c).

3. An authorised person or an approved inspection authority shall issue a certificate of conformity after completion of a gas installation, modification ,alteration or change of user or ownership in the form of Annexure 1.”

The Vessels under Pressure Regulation, 1996, published under Government Notice No. R. 1591, dated 4 October 1996, has been repealed by the PER.

The Pressure Equipment Regulations (PER) incorporate the South African Bureau of Standards (SABS) Standards and Codes of Practice relating to all Gases.

11.  Deposits of the quotation price are required before commencement of the installation unless otherwise stated. The balance of payment is required on completion of the installation.

12.  Payment. All goods, installations and appliances are strictly on COD and remain the property of Kurts Gas Appliances   until such times as they are fully paid for. Full payment is required for any products ordered (i.e. hobs, geysers etc.) on placement of order and a deposit on the installation price quoted. 

13.  If For whatever reason the contractor or customer or end user cancels the installation 85% of the deposit for gas installation fee will not be refunded.

14. A contractor or customer or end user cancels the order for a gas appliance a 85% handeling fee will be deducted on a re fund. the contractor or customer or end user will have to wait for such time until the gas appliance , gas appliances can be re sold to return the deposits.

15. A contractor or customer or end user can not cancell the order of a gas appliance if for whatever reason the gas appliance cannot be deliverd on time.

16.  A lead time of 3 (three) working days is needed once the deposit has been received before the commencement of the installation unless otherwise stated.
